Terms of Service

These terms govern your use of the EclipseDS apps, the optional account, and the eclipseds.com website. By using EclipseDS, you agree to them. If you don't agree, please don't use the service.
1. What EclipseDS is
EclipseDS is a Nintendo DS emulator. It runs game files that you supply. EclipseDS does not include, distribute, or link to any game files (ROMs), BIOS images, or copyrighted game content, and provides no way to obtain them.
2. Your game files are your responsibility
You are solely responsible for the game files you load into EclipseDS and for ensuring you have the legal right to use them in your jurisdiction. Do not use EclipseDS to infringe anyone's copyright. We do not receive, store, or have access to your game files.
3. Accounts
- An account is optional. You may need one for cross-device save sync and to carry purchases across devices.
- You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.
- You must be old enough to form a binding contract where you live, and at least 13. EclipseDS is not intended for children under 13.
- We may suspend or terminate accounts that abuse the service, attempt to break its security, or violate these terms.
4. Cloud saves
If you enable it, EclipseDS backs up game saves you choose to your account and restores them on your devices. This is a convenience feature provided as-is. Sync and storage can fail, and conflicting saves from different devices may need to be resolved. Keep your own backups of important saves. We are not responsible for lost, corrupted, or overwritten save data. Free accounts have storage limits that may change over time.
5. Purchases
EclipseDS is free to download and play, supported by an occasional ad banner. You may make an optional one-time purchase to remove ads, honored across the platforms where you sign in. Purchases are processed by the relevant app store or payment provider, and refunds are subject to their policies. Entitlements are tied to your account.
6. Acceptable use
Don't misuse the service. In particular, don't:
- use EclipseDS or your account to distribute or obtain infringing content;
- attempt to access other users' data, or probe, scan, or breach security;
- abuse the sync, bug-report, or other features to spam, overload, or disrupt the service;
- resell or commercially redistribute the app without permission.
7. Intellectual property
EclipseDS, its name, logo, and software are ours or our licensors'. These terms grant you a personal, non-exclusive, non-transferable license to use the app for its intended purpose. "Nintendo DS" and related marks belong to Nintendo; EclipseDS is an independent project and is not affiliated with, endorsed by, or sponsored by Nintendo.
8. Third-party services
If you link RetroAchievements or SteamGridDB, or sign in with Google, your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.
9. Disclaimers
EclipseDS is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any particular game will run, that the service will be uninterrupted or error-free, or that saves will always sync or be preserved.
10. Limitation of liability
To the fullest extent permitted by law, EclipseDS and its contributors will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, saves, profits, or goodwill, arising from your use of the service. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Changes
We may update these terms as the product changes. We will update the "last updated" date, and continued use after changes take effect means you accept the updated terms.
